These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with the GymPal application (the "Service") operated by Dot Com Ventures team ("us", "we", or "our").

Please read these Terms and Conditions carefully before using our GymPal application (the "Service").

Acceptance of Terms

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

Subscriptions

  • Some parts of the Service are billed on a subscription basis ("Subscription(s)").
  • You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis.
  • Subscriptions automatically renew at the end of each Billing Cycle unless canceled by you or the GymPal team.
  • Cancelations can be made through your online account management page or by contacting customer support.
  • Valid payment method required (credit card). You must provide accurate billing information.
  • Authorization is granted to charge Subscription fees to your payment method.
  • Failed automatic billing will result in an electronic invoice requiring manual payment.

Fee Changes

  • Subscription fees may be modified at any time.
  • Changes become effective at the end of the current Billing Cycle.
  • Reasonable prior notice will be provided for fee changes.
  • Continued use after changes constitutes agreement to new fees.

Refunds

  • Refund requests considered on a case-by-case basis.
  • Granted at sole discretion of the GymPal team.

Content

  • Service allows posting/sharing of text, graphics, videos ("Content").
  • You retain ownership rights but grant us license to use, modify, and distribute Content.
  • You represent and warrant that:
    1. You own the Content or have rights to use it
    2. Content doesn't violate any third-party rights

Accounts

  • Must provide accurate and current account information.
  • You're responsible for password security and account activities.
  • Notify us immediately of unauthorized account use.
  • Prohibited usernames include:
    • Names of other persons/entities
    • Trademarked names
    • Offensive/vulgar names

Copyright Policy

  • Submit copyright infringement notices via our Contact Us page.
  • Include detailed description of alleged infringement.
  • Misrepresentation of infringement may result in liability for damages.

Intellectual Property

  • Service and original content remain exclusive property of the GymPal team.
  • Protected by UK copyright/trademark laws.
  • Trademarks may not be used without prior written consent.

  • We're not responsible for third-party content/services.
  • Third-party links may have different terms/privacy policies.

Termination

  • We may terminate accounts immediately for any reason.
  • Termination results in immediate service access revocation.
  • Users may terminate accounts by discontinuing service use.

Limitation Of Liability

  • Not liable for indirect, incidental, or consequential damages including:
    • Loss of profits/data
    • Unauthorized access/use
    • Third-party conduct/content
  • Applies regardless of legal theory (contract, tort, etc.)

Disclaimer

  • Service provided "AS IS" without warranties:
    • No guarantee of uninterrupted/error-free service
    • No virus-free guarantee
    • No warranty of results quality
  • Excludes implied warranties of merchantability/fitness.

AI Chatbot Service ("Flex")

1. Nature of AI Service

1.1 AI-Powered Service Disclosure

  • The chatbot service "Flex" is powered by artificial intelligence and machine learning technology
  • You acknowledge that you are interacting with an AI system, not a human representative
  • The AI chatbot operates through automated responses based on pre-programmed algorithms and training data
  • Responses are generated automatically without direct human supervision for each interaction

1.2 Service Limitations

  • The AI chatbot may provide inaccurate, incomplete, outdated, or inconsistent information
  • The service is provided on an "as-is" and "as-available" basis without warranties of any kind
  • Technical interruptions, errors, or malfunctions may occur at any time
  • We do not guarantee the continuous availability or error-free operation of the AI chatbot

2. Medical and Fitness Disclaimers

2.1 Not Professional Advice

  • IMPORTANT: The AI chatbot does not provide medical, healthcare, or professional fitness advice
  • All information provided is for general informational and educational purposes only
  • The chatbot's responses do not constitute professional consultation or diagnosis

2.2 User Responsibility for Health Information

  • Conversation data is retained for service improvement and legal compliance purposes
  • You may request deletion of your conversation data by contacting customer support

3.4 AI Training Restrictions

  • We do not use your personal conversations to train AI models without explicit consent
  • Third-party AI providers are contractually prohibited from using your data for their own model training

4.3 Risk Acknowledgment

  • You use the service at your own discretion and risk
  • We are not responsible for decisions made based on chatbot information
  • You waive claims related to reliance on AI-generated content

5. Liability and Disclaimers

5.1 Limitation of Liability

  • We disclaim all liability for damages arising from use of the AI chatbot service
  • This includes direct, indirect, incidental, consequential, or punitive damages

  • Maximum liability is limited to £100 or amounts paid for services in the preceding 12 months
